Article 1 (Purpose) These Terms and Conditions are intended to regulate the rights, obligations, and responsibilities of the cyber mall and users in relation to the Internet-related services (hereinafter referred to as "Services") provided by the Allville Cyber Mall (hereinafter referred to as the "Mall"), operated by Allville Company (an e-commerce business operator). ※ "These Terms and Conditions shall also apply to e-commerce using PC communication, wireless communication, etc., unless they conflict with the nature of such services." Article 2 (Definition) ① “Mall” refers to a virtual business establishment established by Olville Company to enable users to trade goods or services (hereinafter referred to as “goods, etc.”) using information and communication equipment such as computers, and is also used to refer to a business operator that operates a cyber mall. ② “User” refers to members and non-members who access the “Mall” and receive services provided by the “Mall” in accordance with these Terms and Conditions. ③ “Member” refers to a person who has registered as a member of the “Mall” and can continuously use the services provided by the “Mall.” ④ “Non-member” refers to a person who uses the services provided by “Mall” without registering as a member. Article 3 (Specification, explanation, and revision of terms and conditions, etc.) ① "Mall" shall post the contents of these Terms and Conditions, the name and representative name, the address of the business location (including the address of the place where consumer complaints can be handled), telephone number, facsimile number, e-mail address, business registration number, mail-order business report number, personal information manager, etc. on the initial service screen (front page) of 00 Cyber Mall so that users can easily view them. However, the contents of the Terms and Conditions may be made available to users through a link screen. ② “Before a user agrees to the terms and conditions, the mall must obtain the user’s confirmation by providing a separate link screen or pop-up screen to ensure that the user understands important information stipulated in the terms and conditions, such as cancellation of subscription, delivery responsibility, and refund conditions. ③ “Mall” may revise these Terms and Conditions to the extent that it does not violate related laws such as the Act on Consumer Protection in Electronic Commerce, etc., the Act on Regulation of Terms and Conditions, the Framework Act on Electronic Documents and Transactions, the Electronic Financial Transactions Act, the Electronic Signature Act, the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc., the Act on Door-to-Door Sales, etc., and the Framework Act on Consumers. ④ When the "Mall" revises these Terms and Conditions, it will post the effective date and reason for the revision on the Mall's home screen along with the current Terms and Conditions, from 7 days prior to the effective date until the day before the effective date. However, if the Terms and Conditions are changed in a way that is disadvantageous to users, it will post a notice at least 30 days in advance. In this case, the "Mall" will clearly compare the pre- and post-revision terms and conditions so that users can easily understand them. ⑤ If the "Mall" revises the Terms and Conditions, the revised Terms and Conditions will only apply to contracts entered into after the effective date. For contracts entered into prior to the effective date, the terms and conditions prior to the revision will remain in effect. However, if a user who has already entered into a contract expresses a desire to be subject to the revised Terms and Conditions and sends a notice to the "Mall" within the notice period for the revised Terms and Conditions pursuant to Paragraph 3 and receives the "Mall's" consent, the revised Terms and Conditions will apply. ⑥ Matters not specified in these Terms and Conditions and the interpretation of these Terms and Conditions shall be governed by the Act on Consumer Protection in Electronic Commerce, etc., the Act on Regulation of Terms and Conditions, the Consumer Protection Guidelines in Electronic Commerce, etc. established by the Fair Trade Commission, and related laws and regulations or customary practices. Article 4 (Provision and Change of Services) ① “Mall” performs the following tasks: 1. Provision of information on goods or services and conclusion of purchase contracts 2. Delivery of goods or services for which purchase contracts have been concluded 3. Other tasks determined by “Mall” ② In the event of a product or service being out of stock or its technical specifications changing, "Mall" may change the content of the product or service to be provided under a future contract. In such cases, the content of the changed product or service and the date of provision will be immediately announced in the same location where the current product or service content is posted. ③ If the content of the service that “Mall” has agreed to provide to the user is changed due to reasons such as the product being out of stock or changes in technical specifications, the reason will be immediately notified to the user at an address where the user can be reached. ④ In the case of the preceding paragraph, “Mall” shall compensate for any damages suffered by the user. However, this shall not apply if “Mall” proves that there was no intent or negligence. Article 5 (Service Interruption) ① “Mall” may temporarily suspend the provision of services in the event of maintenance, inspection, replacement, or malfunction of information and communication equipment such as computers, or disruption of communication. ② “Mall” shall compensate for any damages suffered by users or third parties due to temporary suspension of service provision for the reasons set forth in Paragraph 1. However, this shall not apply if “Mall” proves that there was no intent or negligence. ③ In the event that the service cannot be provided due to reasons such as a change in business type, abandonment of business, or merger between companies, the “Mall” will notify the user in the manner specified in Article 8 and compensate the consumer according to the terms and conditions initially presented by the “Mall.” However, if the “Mall” fails to notify the compensation standards, etc., the “Mall” will pay the user’s mileage or accumulated points, etc. in kind or cash equivalent to the currency value used in the “Mall.” Article 6 (Membership Registration) ① Users apply for membership by filling out membership information according to the registration form provided by “Mall” and indicating their agreement to these Terms and Conditions. ② “Mall” registers as a member users who have applied for membership as per Paragraph 1, unless they fall under any of the following items: 1. If the applicant has previously lost membership qualifications pursuant to Article 7, Paragraph 3 of these Terms and Conditions, however, this does not apply to those who have lost membership qualifications pursuant to Article 7, Paragraph 3 and have obtained approval for re-registration as a member from “Mall.” 2. If there are any false, omitted or erroneous entries in the registration information . 3. If “Mall” determines that registering as a member significantly hinders the technology of the “Mall.” ③ The time of establishment of the membership agreement is when the “Mall”’s approval reaches the member. ④ If there is a change in the information registered at the time of membership registration, the member must notify the “Mall” of the change within a reasonable period of time by way of modifying the member information. Article 7 (Withdrawal of membership and loss of qualification, etc.) ① Members may request withdrawal from the “Mall” at any time, and the “Mall” will immediately process the withdrawal. ② If a member falls under any of the following reasons, the “Mall” may restrict or suspend membership. 1. If false information is registered when applying for membership. 2. If the member does not pay the price of goods purchased through the “Mall” or other debts incurred by the member in relation to the use of the “Mall” on the due date. 3. If the member threatens the order of e-commerce by interfering with another person’s use of the “Mall” or stealing information. 4. If the member uses the “Mall” to commit an act prohibited by law or these Terms and Conditions or against public order and morals. ③ If the same act is repeated more than twice or the reason is not corrected within 30 days after “Mall” has restricted or suspended membership, “Mall” may revoke membership. ④ If a "Mall" member loses their membership, their membership will be canceled. In this case, the member will be notified and given at least 30 days to explain their reasons before the cancellation. Article 8 (Notice to Members) ① When “Mall” notifies a member, it may do so to the e-mail address designated by the member in advance through agreement with “Mall.” ② In the case of notifications to an unspecified number of members, "Mall" may substitute individual notifications by posting the notice on the "Mall" bulletin board for at least one week. However, individual notifications will be provided for matters that have a significant impact on the member's transactions. Article 9 (Purchase application and consent to provision of personal information, etc.) ① “Mall” users apply for purchases on the “Mall” using the following or similar methods, and the “Mall” must provide the following information in an easily understandable manner when users apply for purchases. 1. Search and selection of goods, etc. 2. Input of recipient’s name, address, phone number, email address (or mobile phone number), etc. 3. Confirmation of terms and conditions, services with limited right of cancellation, cost burden such as delivery and installation fees, etc. 4. Agree to these terms and conditions and indicate whether to confirm or reject the matters in item 3 above (e.g., mouse click) 5. Application for purchase of goods, etc. and confirmation thereof or consent to confirmation by the “Mall” 6. Selection of payment method ② If the "Mall" needs to provide a buyer's personal information to a third party, it must notify the buyer and obtain consent regarding 1) the recipient of the personal information, 2) the recipient's purpose for using the personal information, 3) the items of personal information provided, and 4) the recipient's retention and use period. (The same applies if the consented information changes.) ③ In the event that a “Mall” entrusts a third party with handling the purchaser’s personal information, 1) the person entrusted with handling personal information, and 2) the details of the entrusted work must be notified to the purchaser and consent obtained. (The same applies if the matters for which consent has been obtained are changed.) However, in the event that it is necessary for the performance of a contract for the provision of services and is related to the promotion of the purchaser’s convenience, the notification and consent procedures may be omitted by notifying through the personal information handling policy in the manner stipulated in the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc. Article 10 (Establishment of Contract) ① “Mall” may not accept purchase applications as per Article 9 in the following cases. However, when entering into a contract with a minor, the minor or his/her legal representative may cancel the contract if the consent of the legal representative is not obtained. 1. If there is any false information, omission, or error in the application . 2. If a minor purchases goods or services prohibited by the Youth Protection Act, such as cigarettes or alcohol. 3. If “Mall” determines that accepting the purchase application would significantly hinder the technology of “Mall”. ② The contract is deemed to have been concluded at the time when the “Mall”’s approval reaches the user in the form of a confirmation of receipt as per Article 12, Paragraph 1. ③ The “Mall”’s expression of intent to accept must include information such as confirmation of the user’s purchase request, availability for sale, correction or cancellation of the purchase request, etc. Article 11 (Payment Method) Payment for goods or services purchased from the "Mall" may be made using any of the available methods listed below. However, the "Mall" may not collect any fees under any pretext in addition to the price of goods, etc., for the user's payment method. 1. Various account transfers, including phone banking, internet banking, and mail banking. 2. Payment by various cards such as prepaid cards, debit cards, and credit cards 3. Online bank transfer 4. Payment by electronic money 5. Payment upon receipt 6. Payment using points provided by “Mall” such as mileage 7. Payment by gift certificate contracted with “Mall” or approved by “Mall” 8. Payment by other electronic payment methods, etc. Article 12 (Confirmation of receipt, change and cancellation of purchase request) ① When a user makes a purchase request, “Mall” sends a receipt confirmation notice to the user. ② If a user who has received a receipt confirmation notice finds any discrepancies in the intent, he or she may immediately request a change or cancellation of the purchase application. The "Mall" must promptly process such requests prior to delivery. However, if payment has already been made, the provisions of Article 15 regarding withdrawal of subscription, etc. shall apply. Article 13 (Supply of goods, etc.) ① Unless otherwise agreed upon with the user regarding the timing of supply of goods, the "Mall" shall take necessary measures, such as custom manufacturing and packaging, to ensure delivery of goods within 7 days from the date the user places an order. However, if the "Mall" has already received all or part of the payment for the goods, measures shall be taken within 3 business days from the date of receipt of all or part of the payment. In this case, the "Mall" shall take appropriate measures to ensure that the user can check the supply procedures and progress of the goods. ② The "Mall" specifies the delivery method, who pays the delivery costs for each method, and the delivery period for each method for goods purchased by the user. If the "Mall" exceeds the agreed delivery period, it must compensate the user for any resulting damages. However, this does not apply if the "Mall" proves that there was no intent or negligence. Article 14 (Refund) If “Mall” is unable to deliver or provide the goods, etc. that the user has requested to purchase due to reasons such as being out of stock, it will promptly notify the user of the reason and, if it has received payment for the goods, etc. in advance, refund the payment or take necessary measures for refund within 3 business days from the date of receipt of payment. Article 15 (Withdrawal of subscription, etc.) ① Users who have entered into a contract for the purchase of "Mall" goods, etc. may withdraw their subscription within seven days of receiving a written notice regarding the contract terms pursuant to Article 13, Paragraph 2 of the Act on Consumer Protection in E-Commerce, etc. However, if the Act provides otherwise regarding subscription withdrawal, such provisions shall apply. ② In the case where the user receives goods, etc., return or exchange is not possible in the following cases. 1. If goods are lost or damaged due to reasons attributable to the user. 2. When the value of goods, etc. has significantly decreased due to use or partial consumption by the user. 3. When the value of goods, etc. has significantly decreased over time to the extent that resale is difficult. 4. If the packaging of the original product is damaged when it can be copied with a product of the same performance. ③ In the case of subparagraphs 2 through 4 of paragraph 2, if the “Mall” does not clearly state in advance in a place where consumers can easily see that cancellation of subscription, etc. is restricted, the user’s cancellation of subscription, etc. will not be restricted. ④ If the content of the goods, etc. is different from the displayed or advertised content or if the performance is different from the contractual content, the user may cancel the subscription, etc. within 3 months from the date of receipt of the goods, etc. or within 30 days from the date the user became aware of the fact or could have become aware of the fact. Article 16 (Effects of withdrawal of subscription, etc.) ① If the "Mall" receives a return of goods from a user, it will refund the payment already made for the goods within three business days. In this case, if the "Mall" delays the refund of goods to the user, it will pay a delay interest as prescribed by law for the delay period. ② When refunding the above amount, if the user has paid for the goods, etc. using a payment method such as a credit card or electronic money, “Mall” will request the business operator who provided the payment method to suspend or cancel the payment without delay. ③ In the event of a cancellation of subscription, etc., the user shall bear the costs of returning the goods supplied. However, if the contents of the goods differ from the displayed or advertised contents or the contractual terms are not fulfilled, the cost of returning the goods shall be borne by "Mall." ④ If the user bears the shipping cost when receiving goods, etc., “Mall” clearly indicates the party responsible for the cost when canceling the subscription. Article 17 (Personal Information Protection) ① “Mall” collects the minimum amount of personal information necessary to provide services when collecting users’ personal information. ② "Mall" does not collect information necessary for purchase contract fulfillment in advance upon membership registration. However, if identity verification is required to fulfill obligations under relevant laws and regulations, a minimum amount of specific personal information may be collected. ③ “Mall” collects and uses users’ personal information by notifying them of the purpose and obtaining their consent. ④ "Mall" may not use collected personal information for purposes other than those intended. If a new purpose arises or if personal information is provided to a third party, "Mall" will notify the user and obtain consent at the time of use or provision. Exceptions may apply where otherwise provided by law. ⑤ “Mall” must obtain the user’s consent by specifying the identity of the person responsible for managing personal information, the purpose of collection and use, and matters related to the provision of information to third parties. Users may withdraw their consent at any time. ⑥ Users may request access to and correction of errors in their personal information held by the “Mall” at any time, and the “Mall” will take necessary measures without delay. ⑦ “Mall” limits the number of people handling personal information to a minimum in order to protect the personal information of users, and assumes full responsibility in the event that damage occurs to the personal information of users due to loss, theft, leakage, etc. ⑧ “Mol” destroys personal information without delay when the purpose of collecting personal information has been achieved. ⑨ "Mall" does not pre-select the consent box for the collection, use, and provision of personal information. Furthermore, it specifically states the services that will be restricted if a user refuses to consent to the collection, use, and provision of personal information. Furthermore, "Mall" does not restrict or refuse services, such as membership registration, due to a user's refusal to consent to the collection, use, and provision of non-mandatory personal information. Article 18 (Obligations of “Mall”) ① “Mall” shall not engage in any acts prohibited by laws and regulations or these Terms and Conditions or contrary to public order and morals, and shall do its best to provide goods and services continuously and stably in accordance with these Terms and Conditions. ② “Mall” must have a security system to protect users’ personal information (including credit information) so that users can safely use Internet services. ③ If a “Mall” causes damage to a user by engaging in unfair labeling or advertising practices as defined in Article 3 of the Act on Fair Labeling and Advertising with respect to a product or service, the “Mall” shall be liable for compensation. ④ “Mall” does not send commercial e-mails for profit that users do not want. Article 19 (Member ID and Password Obligations) ① Except for the case in Article 17, the member is responsible for managing his/her ID and password. ② Members must not allow third parties to use their ID and password. ③ If a member becomes aware that his/her ID and password have been stolen or are being used by a third party, he/she must immediately notify the “Mall” and follow the “Mall’s” instructions, if any. Article 20 (User Obligations) Users must not perform the following actions: 1. Registration of false information when applying or changing information 2. Stealing other people's information 3. Changes to information posted on “Mall” 4. Transmission or posting of information (computer programs, etc.) other than information specified by “Mall” 5. Infringement of intellectual property rights, including copyrights, of “Mall” or other third parties 6. Any act that damages the reputation of a “Mol” or other third party or interferes with their business. 7. Acts of disclosing or posting obscene or violent messages, images, audio, or other information that violates public order and morals on the mall. Article 21 (Relationship between the connecting “mall” and the connected “mall”) ① When an upper “mall” and a lower “mall” are connected by a hyperlink (e.g., the target of the hyperlink includes text, pictures, and moving images), the former is called a connecting “mall” (website) and the latter is called a connected “mall” (website). ② If the linked “mall” clearly states on its initial screen or a pop-up screen at the time of connection that it does not bear warranty responsibility for transactions between users and goods, etc. provided independently by the linked “mall,” then it does not bear warranty responsibility for such transactions. Article 22 (Attribution of copyright and restrictions on use) ① The copyright and other intellectual property rights for works created by “Mall” belong to “Mall.” ② Users must not use for profit or allow third parties to use for profit information obtained through the use of the “Mall” by means of reproduction, transmission, publication, distribution, broadcasting or other methods without the prior consent of the “Mall” if the intellectual property rights to such information belong to the “Mall.” ③ “Mall” must notify the user in case it uses the copyright belonging to the user according to the agreement. Article 23 (Dispute Resolution) ① “Mall” establishes and operates a damage compensation processing organization to reflect legitimate opinions or complaints raised by users and compensate for any damages. ② "Mall" prioritizes handling complaints and opinions submitted by users. However, if prompt handling is difficult, the user will be immediately notified of the reason and processing schedule. ③ In the event of a request for relief from damages by a user in connection with an e-commerce dispute between the “Mall” and the user, the request may be subject to mediation by a dispute mediation agency commissioned by the Fair Trade Commission or the city/provincial governor. Article 24 (Jurisdiction and Governing Law) ① Litigation regarding e-commerce disputes arising between a "Mall" and a user shall be under the exclusive jurisdiction of the local court having jurisdiction over the user's address at the time of filing. If the user has no address, the local court having jurisdiction over the user's place of residence shall have exclusive jurisdiction. However, if the user's address or place of residence is unclear at the time of filing, or if the user is a foreign resident, the lawsuit shall be filed with the court having jurisdiction under the Civil Procedure Act. ② Korean law applies to e-commerce lawsuits filed between “Mall” and users.
